These Terms & Conditions are provided for general informational purposes and reflect MACS Plumbing Company’s current service policies. Policies may be updated from time to time.
The terms and conditions applicable to any specific project or service are those provided with the written estimate, work authorization, or invoice issued at the time of service.

MACS Plumbing Company – Terms & Conditions

Authorization to Perform Work
By approving an estimate, signing a work authorization, scheduling service, or allowing work to proceed, the customer authorizes MACS Plumbing Company (“Contractor”) to perform the described services and agrees to these Terms & Conditions.

Scope of Work
Work will be performed only as described in the approved estimate. Any additional work, changes, or unforeseen conditions not included in the original scope may result in additional charges and will require customer approval before proceeding when practical.

Diagnostic Services
Plumbing diagnosis, troubleshooting, and evaluation are professional services. Diagnostic or service fees apply regardless of whether the customer approves recommended repairs.

Minimum Service Charge
Service calls are subject to a minimum one (1) hour labor charge. This minimum covers travel time, professional expertise, diagnostics, administrative costs, and the reservation of a licensed technician’s time, regardless of the duration of on-site work. Additional labor is billed in standard increments thereafter.

Pricing & Estimates
Estimates are based on visible and reasonably accessible conditions at the time of inspection. A non-refundable estimate fee of $185 plus applicable gross receipts tax (GRT) is due at the time the estimate is performed, prior to the technician leaving the property. The estimate fee covers professional evaluation, diagnostics, and preparation of the estimate.

If the customer approves and proceeds with the proposed work, $185 will be applied as a credit toward the final invoice. The credit applies to labor and services only and does not include any gross receipts tax paid. If the customer elects not to proceed, the estimate fee remains due and payable.

Plumbing systems may contain concealed, pre-existing, or code-deficient conditions that cannot be identified until work begins. Pricing may change if conditions differ from what was originally observed.

Existing Systems, Water Quality & Infrastructure Conditions
Plumbing work may impact aging piping, fixtures, valves, or materials that are brittle, corroded, scaled, improperly installed, or otherwise compromised due to age, water quality, pressure, soil conditions, or prior installation methods. Contractor is not responsible for failures or leaks resulting from pre-existing system conditions revealed during or after work.

Incidental Damage & Additional Repairs
Plumbing systems, piping, fittings, valves, and underground components may be aged, brittle, corroded, or compromised prior to service. During normal plumbing work, adjacent or downstream components may crack, break, leak, or fail due to these conditions.

Contractor is not responsible for such pre-existing failures. Any additional labor, excavation, materials, or repairs required to restore system functionality are not included in the original estimate and are billable. When practical, customer approval will be obtained prior to proceeding; however, Contractor is authorized to perform necessary repairs to prevent active leaks, property damage, or unsafe conditions.

Payment Terms
Payment is due upon completion of work unless otherwise stated in writing. Deposits may be required for larger projects or special-order materials. Accepted payment methods may include cash, check, credit card, or other approved methods. Unpaid balances may be subject to late fees, service charges, and collection costs as permitted by New Mexico law.

Invoices are not subject to unilateral deductions or offsets. The customer may not withhold, reduce, or deduct amounts from an invoice for third-party work, materials, perceived deficiencies, or unrelated expenses unless such deductions were agreed to in writing by the Contractor in advance. Any concerns regarding billing or workmanship must be communicated promptly so they may be reviewed and addressed separately.

Permits & Code Compliance
When required, permits will be obtained and work will be performed in accordance with applicable New Mexico plumbing codes and local amendments for the approved scope of work.

During permitted work, inspection authorities may require correction, modification, or replacement of existing plumbing systems or components that are not part of the original scope of work but are exposed or identified during inspection. Such corrections are not included in the original estimate and will result in additional labor, materials, and permit-related costs.

Permit fees, re-inspections, inspector directives, and delays beyond the Contractor’s control are not included unless specifically stated.

Customer Responsibilities
The customer agrees to provide safe and reasonable access to the work area, including securing pets, providing utility access, and maintaining clear working conditions. Contractor is not responsible for delays, damage, or inability to complete work caused by unsafe, obstructed, or undisclosed conditions.

Customer-Supplied Materials
Contractor does not warranty customer-supplied materials, fixtures, or equipment. Contractor is not responsible for the performance, design limitations, manufacturing defects, compatibility, or long-term reliability of customer-supplied products.

Customer-supplied fixtures may function properly at the time of installation and testing but may later leak, loosen, or malfunction due to product design, material quality, internal components, or manufacturer tolerances. Such conditions are not the result of improper installation.

If customer-supplied materials are incorrect, incomplete, defective, or otherwise prevent completion of the scheduled work, the service call remains subject to the minimum one (1) hour labor charge of $185, as the appointment time was reserved and administrative time is required to reschedule the work. Any additional service calls, adjustments, diagnostics, or repairs related to customer-supplied materials are billable.

Warranties
Contractor warrants labor workmanship for a limited period of 30 days as allowed by law. Manufacturer warranties apply to materials and equipment and are subject to manufacturer terms. Warranty does not cover normal wear, misuse, freezing, water quality conditions, improper maintenance, acts of nature, or work performed by others.

Access & Surface Disclaimer
Plumbing work may require opening walls, floors, ceilings, cabinetry, tile, plaster, or other surfaces. Cosmetic repairs, patching, painting, or restoration are not included unless explicitly stated in the estimate. Contractor is not responsible for pre-existing damage or concealed defects.

Scheduling & Delays
Scheduling is subject to material availability, inspections, weather, and unforeseen site conditions. Contractor is not responsible for delays beyond its reasonable control.

Right to Refuse or Stop Work
Contractor reserves the right to refuse, suspend, or terminate work due to unsafe conditions, lack of access, non-payment, customer interference, or requests to perform work that is unsafe, illegal, or not code-compliant.

Limitation of Liability
To the fullest extent permitted by law, Contractor’s liability is limited to the amount paid for the work performed. Contractor is not liable for indirect, incidental, or consequential damages.

Lien Rights
Contractor reserves the right to file a mechanic’s lien or pursue other lawful remedies for non-payment as allowed under New Mexico law.

Governing Law
These Terms & Conditions are governed by the laws of the State of New Mexico.
